1. Acceptance of Terms

By accessing or using PicEnhance ("Service"), you agree to be legally bound by these Terms of Service ("Terms"). If you do not agree, you must discontinue use of the Service immediately.

2. Eligibility

You must be at least 16 years old to use the Service. By using PicEnhance, you represent and warrant that you meet this requirement.

3. License to Use the Service

Subject to these Terms, PicEnhance grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes.

4. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities occurring under your account. You agree to notify us immediately of any unauthorized access or use.

5. User Content & License

• You retain ownership of your uploaded and generated images.
• You grant PicEnhance a limited, worldwide, royalty-free license to store, process, reproduce, and display your content solely to operate and provide the Service.
• Your content is not used for advertising or independent AI model training.

6. Representations & Warranties

You represent and warrant that:

• You own or have the legal right to upload any content you submit.
• You have obtained consent from any individual appearing in uploaded images.
• Your content does not violate any law, intellectual property right, or privacy right.

7. Prohibited Uses

• Uploading photos of others without consent
• Impersonating individuals or public figures
• Generating illegal, harmful, explicit, or abusive content
• Using generated images for fraud, identity deception, or unlawful purposes

Violation of these rules may result in suspension or permanent termination.

8. AI-Generated Content Disclaimer

Content generated by artificial intelligence may contain inaccuracies, distortions, or unrealistic elements. We do not guarantee resemblance, identity accuracy, realism, or suitability for professional, legal, medical, or identification purposes.

9. Content Moderation

We reserve the right, but not the obligation, to review, remove, restrict, or terminate access to content or accounts that violate these Terms or applicable law.

10. Subscriptions & Payments

• Some features require credits or paid subscriptions.
• Subscriptions renew automatically unless canceled through your app store account.
• All billing and refunds are handled by the Apple App Store or Google Play Store.

11. Intellectual Property

All software, presets, branding, design elements, and underlying technology of PicEnhance are owned by us and protected by applicable intellectual property laws.

12. Service Modifications

We may modify, suspend, or discontinue any part of the Service at any time without liability.

13. Indemnification

You agree to indemnify and hold harmless PicEnhance and its operator from any claims, damages, losses, liabilities, or expenses arising from your use of the Service or violation of these Terms.

14. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind, express or implied.

15. Limitation of Liability

To the maximum extent permitted by law, PicEnhance shall not be liable for indirect, incidental, consequential, special, or punitive damages arising from use of the Service.

16. Termination

We may suspend or terminate your access to the Service at our discretion if you violate these Terms.

These Terms are governed by the laws of India, without regard to conflict of law principles.
